Adamawa: S/Court Reserves Judgement in Binani vs Fintiri, others

The Supreme Court on Monday reserved judgment on the appeal filled by the governorship candidate of the All Progressives Congress, APC, Aisha Dahiru against the re-election of Gov. Ahmadu Fintiri of Adamawa.

A five-man panel of the apex court led by Justice John Okoro reserved judgement after taking arguments from all the parties involved.

Dahiru’s counsel, Akin Olujimi had asked the apex court to uphold the declaration made by embattled Hudu Yunusa, an INEC Resident Electoral Commissioner, REC, for being an official of the electoral umpire in line with Section 149 of the Electoral Act.

The Court of Appeal in Abuja had affirmed the election of Fintiri .

A three-member panel of the court had upheld the Oct. 28, 2023 decision of the Adamawa Governorship Election Petitions Tribunal, declaring Fintiri the winner of the March 18 poll.

Mr Dahiru, widely known as Binani, the All Progressives Congress, APC, governorship candidate at the poll, had urged the court to sack Mr Fintiri who was the flagbearer of the PDP on account of INEC’s non-compliance with provisions of the Electoral Act 2022.

In the unanimous judgement, the three-member appellate court panel led by Tunde Awotoye, said Binani failed to prove allegations of non-compliance with the Electoral Act in the conduct of the March governorship election in Adamawa State.

It held that the appellant’s claim of electoral fraud in 14,104 polling stations was not substantiated.

“There is no way three witnesses can prove allegations of noncompliance in 14,104 polling units. Besides, the witnesses were not at the polling units but were campaign coordinators for the appellants”.

The justice equally noted that the record of proceedings transmitted from the tribunal and the briefs to the court were incomplete.

“On the whole, this appeal lacks merit and is accordingly dismissed. The decision of the lower Tribunal is hereby confirmed,” the court awarded N1 million against the petitioners in favour of Fintiri and the PDP.

Governor Fintiri Pardons Nine Inmates, Commutes Death Sentence to Mark Nigeria’s 66th Independence Anniversary In commemoration of Nigeria’s 66th Independence Day celebration, Governor Ahmadu Umaru Fintiri of Adamawa State has granted pardons to nine inmates serving various terms in correctional facilities across the state. A statement issued by the Chief Press Secretary to the Governor, Humwashi Wonosikou, said the Governor ordered the immediate release of the pardoned inmates, noting that all legal formalities had been concluded with the Nigerian Correctional Service. “The Governor acted on the advice of the Advisory Committee on the Prerogative of Mercy and in exercise of the powers conferred on him by Section 212(1)(d) of the Constitution of the Federal Republic of Nigeria, 1999 (as amended),” the statement said. According to the statement, those granted pardon and discharged include Abubakar Dajo, who was serving at the Maximum Security Custodial Centre, Jos; Zabadi Ayuba and Salvation Nyamso, both serving at the Numan Custodial Centre. Others are Amir Idris, Mohammed Saidu, Yaro Sambo, Buhari Salisu, Urube Samuel and Bamaiyi Amos, who were discharged from the Jimeta, Ganye, Guyuk, Yola Old and Kojoli Custodial Centres, respectively. In addition to the pardons, Governor Fintiri approved the commutation of the death sentence imposed on one inmate, Saidu Abdullahi of the Yola Old Custodial Centre, to life imprisonment. The Governor’s action, the statement noted, was in the spirit of the Independence anniversary and reflects the government’s commitment to mercy, justice and the rehabilitation of offenders. The pardons and commutation take immediate effect, the statement added.
