Nnamdi Kanu, the leader of the Indigenous People of Biafra (IPOB), has publicly accused Justice Binta Nyako of refusing to step down from his case due to alleged pressure from the government. According to Kanu, the continued involvement of Nyako is linked to corruption charges against her husband, Murtala Nyako, a former governor, and their son, Abdulaziz Nyako, who are facing investigation by the Economic and Financial Crimes Commission (EFCC).

On February 10, during his ongoing trial, Kanu made these claims in a statement captured in a video that has since circulated widely on social media. He argued that Nyako’s decision to remain in charge of his terrorism-related case was not a personal choice but a result of external forces, including promises from the government to help her family if she convicts him.

While Kanu did not provide further details, it’s known that Murtala Nyako and his son face charges in a N29 billion fraud case. Kanu suggests that Justice Nyako’s continued role in his trial is tied to the government’s influence and the need to benefit her family members.

Kanu’s Previous Request for Recusal

Kanu had formally asked Justice Nyako to recuse herself from his case during a court hearing on September 24, 2024, citing claims of bias. Although Nyako initially agreed to step down, the Chief Judge of the Federal High Court reassigned the case back to her. At the latest hearing, Kanu reiterated his objections, emphasizing that the judiciary had ignored a Supreme Court ruling that ordered his bail to be reinstated.

Kanu further criticized the judiciary for what he perceived as unlawful actions in his trial. He questioned the reasoning behind continuing his case despite the Supreme Court’s directive, accusing the government of disregarding legal procedures.

Judicial Criticism and Legal Challenges

Kanu also expressed concerns about the judiciary’s understanding of the law. He argued that court officials, including the prosecution and Chief Judge, lacked sufficient legal knowledge and were failing to uphold the law. He pointed to Nigerian legal documents stating that once a judge recuses themselves, they cannot be forced to continue overseeing a case.

Rejecting Justice Nyako’s authority, Kanu insisted that her involvement in his case was no longer valid, and he would not recognize her jurisdiction. He made it clear that his appearance in court was only out of courtesy and respect.

In addition to his legal battles, Kanu continued to assert that his pursuit of Biafra’s independence was rooted in his right to self-determination.
